Welcome to AEONFALL (“the Game”), a mobile arcade game published by Xylenzer(“we”, “us”, “our”), an individual developer. By downloading, installing, or playing AEONFALLyou agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Game.
1. License to Use
We grant you a personal, non-exclusive, non-transferable, revocable license to download and play the Game on mobile devices you own or control, solely for your personal entertainment. This license does not include:
- copying, distributing, or publicly displaying the Game or any part of it;
- modifying, adapting, translating, or creating derivative works;
- reverse-engineering, decompiling, or disassembling the Game;
- renting, leasing, selling, sublicensing, or otherwise commercialising the Game;
- removing or altering any proprietary notices or labels.
2. Virtual Items & In-App Purchases
The Game offers optional in-app purchases of virtual coins (consumable) and a one-time starter bundle (non-consumable), sold through the Apple App Store and Google Play. By making a purchase you agree to the payment terms of Apple or Google, as applicable.
Virtual coins and items have no real-world monetary value, cannot be transferred between players, cannot be exchanged for cash or any real-world currency, and are consumed within the Game. We reserve the right to modify, suspend, or remove virtual items at any time.
Purchases are final. Refunds are handled exclusively by Apple or Google under their respective refund policies - please contact the store where you made your purchase. We cannot process refunds directly.
3. Fair Play
You agree not to cheat, hack, exploit bugs, use unauthorised software, or manipulate scores or leaderboards. We may remove manipulated scores and, where appropriate, suspend access to platform services (Game Center / Google Play Games). The integrity of the global leaderboard depends on all players following these rules.
4. Intellectual Property
All content in the Game - including but not limited to art, music, code, text, names, and trade marks - is the property of Xylenzer or its licensors and is protected by applicable intellectual property laws. Nothing in these terms grants you any ownership interest in the Game or its content.
5. Third-Party Services
The Game integrates with Apple Game Center, Google Play Games, Apple StoreKit, and Google Play Billing. Your use of those services is governed by Apple’s and Google’s own terms and privacy policies. We are not responsible for those services or their policies.
6. Disclaimer of Warranties
The Game is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Xylenzer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Game, even if advised of the possibility of such damages. Our total liability to you for any claims under these terms shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Governing Law
These terms are governed by the laws of Thailand, without regard to its conflict-of-law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Thailand.
9. Children
The Game is rated for general audiences and is not directed at children under 13 years of age. We do not knowingly collect personal information from children. If you believe a child has provided personal information in connection with the Game, please contact us and we will take steps to address it.
10. Changes to These Terms
We may update these Terms & Conditions from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Game after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
